Shipped Cooled Semen Contract
This contract entered into on the date of acceptance, by and between the mare owner and the stallion breeder, who mutually agree to abide by the following terms and conditions.

A non-refundable Booking Fee of $200.00 is payable when this contract is signed and returned.  This fee is applied to the total breeding fee, the balance $800.00 of which is payable prior to the shipment of semen.

Conditions Agreed upon:

  • You must give 24 hour advanced notice to Seven Sunday's Ranch at (904) 234-6131 prior to shipping.
  • Mare Owner will return shipping container to Stallion Owner within three (3) days of arrival.
  • Mare owner will pay all shipment costs.
  • Mare owner should have uterine culture performed on the mare prior to insemination, and have her in good breeding health.
  • Breeder guarantees to ship live semen with concentration level adequate to inseminate one mare.  If mare does not become in foal, shipments of semen will be made until end of Farms breeding season, when breeder will no longer collect the stallion for that year.  If mare still is not in foal, mare owner is entitled to rebreed to the stallion for the following years season only.  While no Breeding fee will apply, mare owner must pay all collection and transportation costs.

Guarantee:

  • Breeder guarantees a live foal; defined as a foal that can stand and nurse within 48 hours of birth.  If the mare aborts her foal, or if the foal is stillborn, a return privilege will be granted for the following year only, provided written certification is given by a veterinarian with in seven days that the mare has slipped or produced a nonviable foal.  Return breedings must be preceded by veterinarian check for tract infections.  At the end of this return breeding season, stallion owner shall have no further responsibility for servicing said mare.
  • Mare owner will provide copy of both sides of mares registration certificate to breeder.
  • Should the stallion die or become unfit for service before any necessary re-breed, then this contract shall be voided and service fee will be refunded, less any outstanding amounts due.
  • A breeders certificate will be issued to the mare owner upon notification of the foals birth, and after APHA provides the certificates to breeder.
  • Under no event shall the breeder be liable for cooled semen after shipment reaches destination.

This Contract is entered into in the State of Georgia and will be interpreted and enforced under the laws of that state.  If any clause in this Contract is found to be against State Law, then that clause shall be null and void leaving the balance of the contract enforceable.

Should either party breach this contract, the breaching party shall pay for the other's court cost and attorney's fees related to such breach.

This Contract represents the entire agreement between the parties.  No other agreements or promises, verbal or implied, are included unless specifically stated in this written Contract.  When Mare Owner and Breeder sign this Contract, it will then be binding on both parties, subject to the above terms and conditions.
